We advise and support clients on all aspects of branding and trade mark protection. The process breaks down into three distinct phases – Preparation, Prosecution and Protection.

The Preparation Phase

We consider that the initial development or preparation of a brand is the most important part of the entire process. We therefore help clients, including brand development companies, understand what makes a good trade mark. This involves advising on Trade Marks Registry procedure as well as advice at a conceptual level to try to ensure that clients avoid marks which are unregistrable or problematic. Knowing and avoiding the pitfalls makes for a much simpler and more positive start to business and trade mark life.

An integral part of the Preparation Phase, and essential preparation for filing any applications, is trade mark searching and clearance. This allows us to determine whether there are any potential obstacles to registration before we file. We carry out trade mark searches and clearances worldwide.

Prosecution

We file and prosecute trade mark applications worldwide, where necessary via an international network of trusted agents and associates. We see the entire process through to conclusion, dealing with any objections or oppositions which may arise.

Protection

Once registered, it is important that trade marks are properly protected and exploited on an ongoing basis. We administer and manage entire portfolios of marks on behalf of clients and, where needed, carry out an ongoing watching service which enables us to monitor and, if necessary, oppose new applications which conflict with the interests of our clients. The protection process also extends to trade mark litigation and enforcement of rights, be they based on registered or unregistered trade marks.

We also advise on all aspects of the licensing and exploitation of marks on a national and international basis and negotiate and conclude necessary agreements on behalf of clients.

Domain Names

For many clients, domain names are now an essential business tool and they therefore need as careful consideration and protection as trade marks.

We advise on all aspects of domain name law and practice. Our principal, James Mitchell, is a member of the panel of arbitrators for .eu domain name disputes and our lawyers have extensive experience of dispute resolution under the ICANN and Nominet dispute policies.
