The Notting Hill Shopper Bag - or was that ‘Shopping Bag’?
A decision of the Intellectual Property Enterprise Court (IPEC) was issued today in the case of In Courtenay-Smith & or v. The Notting Hill Shopping Bag Company Ltd & ors [2025] EWHC 1793 (IPEC), in which this firm acted for the Defendants, two traders on the Portobello Road who sell tote bags under certain marks, including The Notting Hill Shopper Bag. Proceedings were brought against them for trade mark infringement, copyright infringement and passing off.
The IPEC found against the Claimants on all three counts.
